ONE CANNOT REJOICE ALREADY PACIFIED WITH GENERAL REPERCUSSION; THE ATTORNEY GENERAL HAS A CHALLENGE AHEAD OF THE SUPREME COURT

Brasilia - The Convergences coalition filed today in Brazilian Attorney General's Office (PGR) a complaint of procedural illegality of the session that, in the Brazilian Supreme Federal Court (STF), judges, for the third time, the imprisonment in the second instance. Created and signed by Dr. Maurício Santos Pereira and also by Jurista Modesto Carvalhosa, the piece demonstrates that the ADCs (Direct Action of Constitutionality) that were used in the second session with the same objective, have already lost the object, that is, if they were already judged procedurally cannot be used again. "It's like reheating the coffee trying to sell it like new," said Thomas Korontai, the coalition's National Coordinator, who made the referral to PGR on Friday afternoon.

The PGR is now expected to have the strength and determination to do what is right within the Law. If the thesis proves to be right, as it is, the session should be interrupted and used ADCs declared ineffective by loss. of object. Dr. Mauricio explains that "the second instance imprisonment  can even be rediscussed, but not under theses already expired and pacified, this is illegal!"

NÃO SE PODE REQUENTAR ASSUNTO JÁ PACIFICADO COM REPERCUSSÃO GERAL; PROCURADOR  GERAL DA REPÚBLICA TEM DESAFIO DIANTE DO STF

Brasília – A coalizão Convergências protocolou hoje na PGR uma denúncia de ilegalidade processual da sessão que, no STF, julga, pela terceira vez, a prisão em segunda instância. Criada e assinada pelo Dr. Maurício Santos Pereira e também pelo Jurista Modesto Carvalhosa, a peça demostra que as ADCs (Ação Direta de Constitucionalidade) que foram utilizadas na segunda sessão com o mesmo objetivo, já perderam o objeto, ou seja, se já foram julgada, processualmente não podem ser utilizadas novamente. “É como requentar 0 café tentar vende-lo como novo”, disse Thomas Korontai, o Coordenador Nacional da coalizão, que fez o encaminhamento à PGR na tarde desta sexta-feira.

Espera-se agora, que a PGR tenha força e determinação para fazer o que é certo, dentro da Lei. Se a tese se provar certa, como de fato está, processualmente, a sessão deverá ser interrompida  e ADCs  utilizadas declaradas sem efeito por perda de objeto. O Dr. Maurício explica que  “a prisão de segunda instância até pode ser rediscutida, mas não sob teses já vencidas e pacificadas, isso é ilegal!”A notícia foi publicada pelo Antagonista, e em vários outros sites e blogs.
