GLEN GREENWLAD MAY BE PROSECUTED BY MILITARY CRIME FOR DISCLOSURE OF CLASSIFIED AS STATE SECURITY INFORMATION.

This is evidenced in the criminal complaint filed by Brazilian lawyer Mário Barbosa Villas Boas, who is currently resident in Canada, with the Military District Attorney of the Federal District, demonstrating that the conversations held between a Federal Prosecutor and a Federal Judge former President Lula's lawsuit were state secrets, and their disclosure could endanger National Security.

What is aggravating to the accused is that he has stated the reasons why he acted, bringing to the public alleged information illegally harvested with mobile phone invasions in conversations by applications among public agents. The  intention of Glen and his friends and related is to overthrow most members of the current Government, especially the current Minister of Justice Sérgio Moro, and the President of the Republic.

EDITORIAL'S OPINION: Brazilian authorities need to act in defense of Brazil and Brazilians through the institutions that are being mockingly attacked by a foreigner on our own territory, and the Military Prosecutor is expected to take appropriate action. The American is on Brazilian soil, conducting interviews and giving blatant disrespect to the institutions of Brazil, urging people to stand against their own country, thus provoking discord and conflict and creating legal insecurity from a psychological point of view. Despite living in a homoaffective relationship with a Brazilian deputy, suspected of having bought the mandate of the then federal deputy Jean Wyllys, the American, who has had problems in other countries, must be criminalized and answer for incitement for the crimes reported by the carioca lawyer.

GLEN GREENWLAD PODE SER PROCESSADO POR CRIME MILITAR POR REVELAÇÃO DE INFORMAÇÕES CLASSIFICADAS COMO DE SEGURANÇA DO ESTADO.

É o que consta, com muitas provas, na denúncia crime proposta pelo advogado  Mário Barbosa Villas Boas, brasileiro, hoje residente no Canadá, junto ao Ministério Público Militar do Distrito Federal, demonstrando que as conversas mantidas entre um Procurador da República e um Juiz Federal sobre processo do ex-presidente Lula eram segredos de Estado, e sua revelação poderia colocar em risco a Segurança Nacional.

O agravante ao acusado é ter afirmado as razões pelas quais agiu, trazendo a público supostas informações colhidas  ilegalmente com invasões a celulares em conversas por aplicativos entre os agentes públicos. A pretensão de Glen e seus amigos e relacionados é derrubar a maior parte dos integrantes do atual Governo, em especial o atual Ministro da Justiça Sérgio Moro, e o Presidente da República.

OPINIÃO DO EDITORIAL: As autoridades brasileiras precisam agir na defesa do Brasil e dos brasileiros, por meio das instituições que estão sendo jocosamente atacadas por um estrangeiro em nosso próprio território, e espera-se que o Ministério Público Militar tome as providências cabíveis. O americano está em solo brasileiro, concedendo entrevistas e dando palestras em flagrante desrespeito às instituições do Brasil, incitando pessoas a se colocarem contra o próprio País, provocando, portanto, discórdia e conflitos e criando insegurança jurídica do ponto de vista psicológico.  Apesar de viver em relação homoafetiva com um deputado brasileiro, suspeito de ter comprado o mandato do então deputado federal Jean Wyllys, o americano, que já teve problemas em outros países, deve ser criminalizado e responder por incitação pelos crimes denunciados pelo advogado carioca.

1 – DOS FATOS

1.1 Em 09/06/2019, o REPRESENTADO publicou em seu blog, denominado “The Intercept”, uma matéria jornalística contendo, entre outras coisas, a transcrição de um diálogo entre o Procurador Federal Deltan Dallagnol e o então juiz da 13a Vara Federal da comarca de Curitiba – hoje Ministro da Justiça – Sérgio Moro. Art. 33. Qualquer pessoa, no exercício do direito de representação, poderá provocar a iniciativa do Ministério Publico, dando-lhe informações sôbre fato que constitua crime militar e sua autoria, e indicando-lhe os elementos de convicção.

Revelação de notícia, informação ou documento Art. 144. Revelar notícia, informação ou documento, cujo sigilo seja de interêsse da segurança externa do Brasil:

Pena – reclusão, de três a oito anos.

1.2 Como pode ser visto nas transcrições constantes nas publicações referidas acima, o objeto do diálogo transcrito – que teria ocorrido, de acordo com a reportagem, via o aplicativo de celular conhecido com o nome de “Telegram” – o objeto da conversa era relativo ao trabalho de ambos, envolvendo a ação penal, onde ambos funcionavam, contra o ex-presidente Luiz Inácio Lula da Silva, hoje encarcerado por ter sido considerado culpado dos crimes que lhes foram imputados na referida ação. O confessado objetivo da reportagem era o de anular a ação que resultou na prisão do ex-presidente devido à existência de supostas irregularidades processuais reveladas pelo diálogo transcrito na mesma.

1.3 A publicação da reportagem supramencionada teve ampla repercussão na imprensa, tendo sido replicada em diversos órgãos de mídia e também objeto de debates no parlamento federal. Devido a essa grande repercussão, o REPRESENTADO foi convidado a participar de uma sessão no Senado Federal onde responderia a perguntas formuladas por senadores sobre a mesma reportagem bem como suas fontes. A sessão em questão aconteceu no dia 11/07/2019 (documento 05). Nela, o REPRESENTADO afirmou – sob compromisso de dizer a verdade, como soe ocorrer nesse tipo de sessão – que os diálogos transcritos são exatos “palavra por palavra”.

1.4 Os interlocutores do diálogo não deram permissão para a divulgação do mesmo nem, por nenhum modo expressaram seu desejo de que o mesmo fosse tornado público.

2 – DO DIREITO

2.1 O diálogo transcrito, por ter sido entre duas autoridades federais – um juiz e um procurador federais – e versar sobre o objeto de trabalho de ambos, caracteriza-se como um assunto de Estado. Se ambos os participantes do diálogo concordam que o mesmo não deveria tornar-se público, POR DEFINIÇÃO trata-se de um SEGREDO DE ESTADO. Assim é que a divulgação não autorizada do referido diálogo configura na publicação não autorizada de um SEGREDO DE ESTADO.

2.2 O SEGREDO DE ESTADO em questão envolve um crime praticado por um ex-Presidente da República quando do exercício de seu mandato. Este assunto é acima de qualquer dúvida um assunto de SEGURANÇA NACIONAL. Destarte, a divulgação não autorizada deste SEGREDO DE ESTADO que se configura num assunto de SEGURANÇA NACIONAL caracteriza o crime cominado no artigo 144 do Código Penal Militar. Máxime ante o fato do objetivo da publicação ser confessadamente o de desconstituir a decisão judicial que determinou a existência do crime e a

responsabilidade penal para o acusado.

2.3 Note-se que para a caracterização do crime supramencionado, irrelevante é a forma como o agente obteve a informação divulgada. Irrelevante é, inclusive, se a forma foi ou não lícita. Relevante é apenas que o agente tenha a ciência de que:

1. Se trata de um ASSUNTO DE ESTADO;

2. Que o assunto é sigiloso;

3. Que o assunto envolva matéria de SEGURANÇA NACIONAL.

2.4 No caso em questão, pela própria matéria divulgada bem como pelos esclarecimentos prestados ao Senado Federal, o REPRESENTADOtinha a ciência dos três pontos acima destacados. Presente, portanto, o DOLO DIRETO da prática do crime cominado no artigo 144 do Codex Criminal Castrense.

3 – DO PEDIDO

Ex Positis, demonstrado, como demonstrado está que o REPRESENTADO divulgou assunto de Estado sigiloso assunto esse que envolvia matéria afeita à segurança nacional, com ciência do sigilo da mesma e de se tratar de matéria de Estado ligada à Segurança nacional, é a presente para requerer a esse órgão ministerial que • INSTAURE inquérito policial militar contra o REPRESENTADO com vistas a identificar outros agentes que possam estar envolvidos no ilícito acima e iniciar ação penal contra este e, possivelmente demais agentes pela prática do crime de Revelação de Notícia, Fato ou Documento (Artigo 144 do Código Penal Militar).

Brasília/DF – A Polícia Federal deflagrou, na manhã de hoje (23/07), a Operação spoofing* com o objetivo de desarticular organização criminosa que praticava crimes cibernéticos.

Foram cumpridas onze ordens judiciais, sendo sete Mandados de Busca e Apreensão e quatro Mandados de Prisão Temporária, nas cidades de São Paulo/SP, Araraquara/SP e Ribeirão Preto/SP.

As investigações seguem para que sejam apuradas todas as circunstâncias dos crimes praticados.

Federal Police opened Operation Spoofing on Tuesday, 23, and arrested 4 suspects of breaking into the cell phone of Justice Minister Sergio Moro, and the prosecutor and coordinator of Operation Lava Jato in Parana, Deltan Dallagnol. The action was determined by the judge of the 10th Federal Court of Brasilia, Vallisney de Souza Oliveira.

In addition to Moro, prosecutors for the Lava Jato task force in Parana and other authorities were hacked - the search warrant mentions federal judge Abel Gomes (Federal Regional Court of the 2nd Region in Rio), federal judge Flávio Lucas ( Federal Court of Rio) and delegates Rafael Fernandes, from PF in São Paulo, and Flávio Vieitez Reis, in Campinas.

Dialogues held at the height of the investigation between them and then-judge Sérgio Moro were leaked and published by The Intercept, indicating an alleged collusion. Moro and the prosecutors do not recognize the authenticity of the messages attributed to them.

The PF served four temporary arrest warrants and seven search and seizure warrants in São Paulo, Araraquara and Ribeirão Preto. The warrants were fulfilled by PF Delegate Luiz Flávio Zampronha, who investigated the Mensalão scandal.

One of the search addresses is the residence of the mother of one of the suspects, arrested in the state capital. He works with shows and events, according to investigators.

"Investigations are continuing to ascertain all the circumstances of the crimes committed," PF said.

Spoofing, according to Federal, is a type of technology forgery that seeks to trick a network or a person into believing that the source of information is reliable when in reality it is not. The operation targets a 'criminal organization that committed cyber crimes'.

Moro had his cell phone turned off on June 4 after realizing that he had been the target of a virtual attack. The minister's cell phone was hacked around 6pm. He only noticed after receiving three calls from his own number. The former judge then summoned Federal Police investigators to report suspected cloning.

Moro's last access to the device was recorded on WhatsApp at 6:23 pm that day.
