Brazilian House Draft Bill No. 2019 (From Mr. Fábio Trad) Amends Decree-Law No. 2848, of December 7, 1940-Penal Code, to include art. 147-A, which provides for obsessive or insidious harassment (stalking). The National Congress decrees: Art. 1º- This Law has the purpose of adding to Decree-Law No. 2848, of December 7, 1940-Criminal Code, the crime of obsessive or insidious harassment. 2º-Decree-Law No. 2848, of December 7, 1940-Criminal Code, becomes effective with addition of art. 147-A with the following wording: Obsessive or insidious harassment147 -Assist someone, invading, limiting or disturbing his or her sphere of freedom or privacy, in order to instill fear of death, physical injury, or cause substantial emotional distress . Prison-seclusion, from two to four years and a fine. Obsessive or insidious behavior qualified. 1 If the perpetrator was or is an intimate partner of the victim. Prison-seclusion, from three to five years and a fine. of Paragraph 1, anyone who practices harassment using information technology for inclusion, alteration of data or usurpation of the victim's digital identity.§3 The penalties provided for in this article are applicable without prejudice to those corresponding to violence.Art.3º-This Law enters in force on the date of its publication.

Our society has come to rely on the sheer size, technological power, and lightening fast speed of the Internet to seek out immeasurable pages of information, explore the unknown, and communicate with virtually anyone, anywhere, and at anytime across the globe. Conversely, the Internet has opened windows of previously unknown criminal opportunities that not only challenge, but also transcend all physical boundaries, borders, and limitations to detect, punish, and diminish what a ppears to be a mounting problem of global proportion. As such, the Internet has literally become a fertile breeding ground for an entirely new and unique type of criminal offender hereafter known as the cyber stalker – an offender who uses the Internet a s a tool or weapon of sorts to prey upon, harass, threaten, and generate immense fear and trepidation in its victims through sophisticated stalking tactics. This paper presents a glimpse into the deviant behaviors and tactics associated with cyber stalking crimes, legislative intervention measures, and preventative initiatives created specifically to curtail this emerging global crime (Pittaro, 2007). However, it has a growing and frightening growth that should be considered as a possible public health problem based on the criteria developed by Leavell and Clark (1976). In this CPI, Janine was not correct when she stated that Smartmatic was hired only to carry the boxes of the electronic ballot boxes to the places of devotion, and that all the computerized solutions, the election programs, are developed by TSE technicians without any action for at least 10 years. However, the terms of the contract signed between the company and the TSE provide training for TSE technicians. Dr. Maria Aparecida Cortiz, an experienced lawyer specializing in cybercrime and, specifically, the electronic voting process, stated that the term "loading" was not for ballot boxes but rather for ballot boxes, that is, loading them with generated media for the company.
Janino also stated that the "inserator", found by the technicians of CMind - Independent Multidisciplinary Committee - can not be compiled and executable for an electronic ballot box, because it is a "programming language". He cited PSOE's peolo auditing in relation to the 2014 elections, which "would have verified the integrity of the programs", which is not true, since the audit report was in the opposite direction, demonstrating the vulnerability of the ballot box and that the " inserator "was never analyzed.

That is, the TSE, through its directors, from the Ministers Dias Toffoli to the current Minister Luiz Fux, through the controversial Gilmar Mendes, all declare themselves against the printed vote or in ballot as a physical check for eventual recounts. And for that, the untruths, omissions and distortions of the information and even of the resolutions made by the TSE, as approached in the Popular Action for the substitution of ballot boxes without printers by the ballot boxes for voting in paper ballots are valid for that.
His statements are recorded in court records and documents, attached to the criminal complaint.
Janino, if indicted, tried and convicted, will be subject to the penalties provided for in Law 10.268, including the possibility of a multiplication by recidivism.

71 MOVEMENTS ARE SIGNATORIES OF A CRIME NEWS AGAINST TSE TECHNOLOGY SECRETARY MR. GIUSEPPE JANINO, FOR FALSE TESTIMONY PRACTICED IN VARIOUS OCCASIONS. THE PARTY WAS PROTOCOLED TODAY IN THE DIRECTORY OF THE FEDERAL POLICE.
Giuseppe Janino was responsible for the implementation of electronic ballot boxes since 1996. He has been questioned in public hearings and also to the CPI of the Cyber Crimes of the Chamber of Deputies, held on November 3, 2015, specifically regarding the electronic ballot box. In this CPI, Janine was not correct when she stated that Smartmatic was hired only to carry the boxes of the electronic ballot boxes to the places of devotion, and that all the computerized solutions, the election programs, are developed by TSE technicians without any action for at least 10 years. Giuseppe Janino foi o responsável pela implantação das urnas eletrônicas desde 1996. Maria Aparecida Cortiz, experiente advogada especializada em crimes cibernéticos e, especificamente do processo eletrônico de votação, declarou que a expressão “carregamento” não era para caixas de urnas mas sim, das urnas, ou seja, carregando-as com mídias geradas pela empresa.
Janino declarou ainda que o “inserator”, encontrado pelos técnicos do CMind – Comitê Multidisciplinar Independente – não pode ser compilado e executável para uma urna eletrônica, por se tratar de “linguagem de programação”. Citou a auditoria feita peolo PSDB, em relação às eleições de 2014, o qual “teria constatado a integridade dos programas”, o que não é verdade, pois o relatório da auditoria foi em direção contrária, demonstrando a vulnerabilidade da urna e que o “inserator” jamais foi objeto de análise.
Há várias outas inconsistências, as quais podem ser observadas na peça de denúncia tais como as inverdades proferidas aos questionamentos da audiência pública realizada no Senado Federal pelo Senador Lasier Martins, quando afirmou que não existem módulos de impressão nas urnas existentes, em contraposição ao próprio ex-presidente do TSE, Ministro Ayres Brito, que, em 2009, revelou que as urnas estavam aptas para módulos externos de impressão, para o atendimento da Lei 12.304/09 em vigência na época.
Ou seja, o TSE, por meio de seus diretores, desde os Ministros Dias Toffoli até o atual Ministro Luiz Fux, passando pelo polêmico Gilmar Mendes, todos se declaram contrários ao voto impresso ou em cédula como contraprova física para fins de eventuais recontagens. E, para isso, valem as inverdades, as omissões e as deformações das informações e até mesmo da resoluções feitas pelo TSE, como abordado na Ação Popular pela substituição das urnas sem impressoras pelas urnas de lona para votação em cédulas de papel.
Suas falas estão registradas em atas e documentos taquigráficos, anexas à denúncia criminal.
Janino, se indiciado, julgado e condenado, será incurso nas penas previstas na Lei 10.268, inclusive com possibilidade de multiplicação por reincidências.

Quem negocia ministérios no Brasil em troca de apoios a coligações é justamente a Esquerda.

Câmara dos DeputadosPROJETO DE LEI Nº , DE 2019(Do Sr. Fábio Trad)Altera o Decreto-Lei nº 2.848, de 7 de dezembro de 1940-Código Penal, para incluir o art. 147-A, que dispõe sobre o crime assédio obsessivo ou insidioso (stalking).O Congresso Nacional decreta:Art. 1º-Esta Lei tem por fim acrescentar ao Decreto-Lei nº 2.848, de 7 de dezembro de 1940 –Código Penal, o crime de assédio obsessivo ou insidioso.Art. 2º-O Decreto-lei nº 2.848, de 7 de dezembro de 1940 -Código Penal, passa a vigorar acrescido do art. 147-A com a seguinte redação:Assédio obsessivo ou insidioso147-AAssediar alguém, de forma reiterada, invadindo, limitando ou perturbando sua esfera de liberdade ou sua privacidade, de modo a infundir medo de morte, de lesão física ou a causar sofrimento emocional substancial.Pena-reclusão, de dois a quatro anos e multa.Assédio obsessivo ou insidioso qualificado§1ºSe o autor do fato foi ou é parceiro íntimo da vítima.Pena–reclusão, de três a cinco anos e multa.§2º Incorre na mesma pena do §1º aquele que praticar o assédio com uso de tecnologia informática para inclusão, alteração de dados ou usurpação de identidade digital da vítima.§3º As penas previstas nesse artigo são aplicáveis sem prejuízo das correspondentes à violência.Art.3º-Esta Lei entra em vigor na data de sua publicação.
Câmara dos Deputados JUSTIFICAÇÃOTrata-se de Projeto de Lei que objetiva criminalizar o delito de perseguição obsessiva ou insidiosa, conhecida também como stalking.A proposta surge da ocorrência de diversos casos de mulheres e homens em todo Brasil que sofrem com perseguições no seu meio social, no trabalho e na internet.O termo stalking, assim utilizado na língua inglesa, é caracterizado, segundo a pesquisadora e promotora de justiça Ana Lara Camargo de Castro por um “comportamento doloso e habitual, consistente em mais de um ato de atenção indesejada, importunação ou perseguição, capaz de acarretar à vítima violação da intimidade, da privacidade ou temor por sua própria segurança”1.Ainda, segundo a ilustre promotora, em sua obra Stalking e Cyberstalking: Obsessão, Internet, Amedrontamento2, o stalking é comumente relacionado à ideia de erotomania3delusória. Mas esta seria apenas uma das facetas possíveis nesse tipo de delito, já que o interesse pessoal do perpetrador poderia variar entre admiração obsessiva, desejo relacional, perversão, vingança, etc.Fala-se na existência de cinco tipos de stalkers: o rejeitado, o rancoroso, o carente de intimidade, o conquistador incompetente e o predador.Com o intuito de contribuir com o debate, achamos importantes transcrever aqui os perfis mais comuns de stalkersabordados pela nobre autora, vejamos:1Ana Lara Camargo de Castro é Promotora de Justiça do Ministério Público do Estado de Mato Grosso do Sul desde 1997. Câmara dos Deputados“O rejeitado vem do contexto de ruptura relacional, usualmente erótico-afetiva, mas também familiar ou de amizade. As motivações desse tipo são reconciliação ou retaliação, que se podem apresentar de forma ambivalente, alternando desejo de reatar o relacionamento e ira. É o tipo que se utiliza da maior variedade de práticas persecutórias e emprega todos os métodos de intrusão e assédio. Vale-se de ameaças em mais de 70% dos casos e escalona para agressão em mais de 50% deles. Em classificações de outros autores, podem ser denominados como obsessivos simples, escanteados ou ex-parceiros. Mas, de toda forma, são os tipos mais comuns, que representam a maioria absoluta dos casos de stalking identificados e nos quais, em regra, incluem-se os stalkers em contexto de violência doméstica e familiar contra a mulher.O rancoroso surge do sentimento de sentir-se maltratado, injustiçado ou humilhado. E a vítima pode ser completa estranha ou mera conhecida a quem ele atribui o distrato. A motivação inicial costuma ser vingança, posteriormente mantida pela sensação de controle que obtém em incutir medo na vítima. Pode também demonstrar ressentimento em relação à empresa, à autoridade ou ao sistema –forças poderosas e opressoras contra as quais acredita estar reagindo. Em classificações diversas, podem ser denominados como stalkers políticos ou de pauta específica.O carente busca intimidade, surge de contexto de solidão e falta de autoconfiança. A vítima costuma ser estranha ou mera conhecida com quem o stalker deseja formar vínculo. É comum que sofra de transtorno delirante de erotomania e acredite estar sendo correspondido. Nessa categoria, encontram-se aqueles que, em classificações propostas por outros autores, podem ser denominados como de fixação delusória, assediadores de celebridades ou erotomaníacos. O conquistador incompetente é aquele que aparece em contexto de solidão ou lascívia, com foco em vítima estranha ou mera conhecida. Diferencia-se daquele carente de intimidade porque sua motivação não é o estabelecimento de vínculo amoroso e, sim, encontro passageiro ou relação sexual. Costuma assediar por curto período de tempo e quando o comportamento é mantido isso se dá por cegueira ou indiferença ao incômodo causado.
Câmara dos DeputadosO predatório surge no contexto de transtorno de preferência sexual (perversão). A motivação costuma ser a gratificação sexual, muitas vezes pelo simples voyeurismo, mas geralmente escalona para estupro, servindo o stalking como instrumento de preparação ou prelúdio para o ataque. O stalker dessa natureza tem prazer na observação sub-reptícia, diferentemente do rancoroso que deseja impor desconforto e medo, o predador muitas vezes não tem qualquer interesse em perturbar a vítima ou alertá-la. Em outras classificações aparece como sádico.”Resta claro que são muitas as formas de assédio insidioso. As mulheres são as maiores vítimas, mas também existem notícias de práticas de assédio de mulheres contra homens, e de homens que assediam outros homens.Seja qual for o perfil do agente (rejeitado, rancoroso, carente de intimidade, conquistador incompetente ou predador), o importante é que protejamos a vítima, mulher ou homem. Hoje, mesmo praticando ações deploráveis, o stalkernão vem sendo responsabilizado quando comete tais atos contra suas vítimas.A questão da criminalização do delito de assédio e perseguição insidiosos foi debatida recentemente no X Fórum Nacional de Juízas e Juízes de Violência Doméstica e Familiar contra a Mulher (FONAVID), realizado no estado de Pernambuco, na cidade de Recife, entre os dias 12 e 15 de novembro de 2018, tendo sido incluída como prioridade na Carta de Recife. Por meio dessa Carta, o Plenário do FONAVID se comprometeu trabalhar pela tipificação da conduta delituosa.Desta feita, a redação aqui apresentada é uma combinação das propostas recebidas por mim em meu gabinete, e de nossas discussões a respeito do tema com os setores interessados.Achamos importante estabelecer, também, uma forma de assédio obsessivo ou insidioso qualificado, que ocorre quando o autor do fato foi ou é parceiro íntimo da vítima, prevendo uma pena de reclusão de três a cinco anos. E nas mesmas penas incorrerão aqueles que praticar o assédio com uso de tecnologia informática para inclusão, alteração de dados ou usurpação de identidade digital da vítima (perseguição cibernética).
Câmara dos DeputadosImportante ressaltar, ainda, que as penas do novo artigo 147-A e parágrafos são aplicáveis sem prejuízo das correspondentes à eventual violência a que a vítima seja submetida.Por essas razões, apresentamos esta proposta, com a finalidade de promover o acréscimo do art. 147-A no código Penal, para que, com sua aprovação, o assediador insidiosopasse a ser responsabilizado por seus atos.Assim, por todo o exposto, é de suma importância a aprovação deste projeto de lei, razão pelo qual contamos com o apoio dos nobres pares. Feriados e stalking: saiba quais projetos bancada federal de MS propôs em 2019
Média da bancada sul-mato-grossense na Câmara dos Deputados é de uma proposição a cada dia, sendo a maioria delas projetos de lei

Antecipação de feriados nacionais e a criminalização do assédio obsessivo, também conhecido como stalking, estão entre as proposições apresentadas pela bancada federal sul-mato-grossense nesta legislatura. Até o momento, foram 60 propostas sendo a maior parte delas projetos de lei, conforme levantamento feito pelo Jornal Midiamax com base nos dados contidos do sistema de Consulta Legislativa da Câmara dos Deputados.
Com sete proposições registradas na Casa – sendo quatro projetos de lei, dois requerimentos e uma ementa, o deputado federal Beto Pereira (PSDB) é autor do PL (Projeto de Lei) 1335/2019 que dispõe sobre a transferência da comemoração dos feriados nacionais. Pela proposta, “serão comemorados por antecipação, nas segundas-feiras, os feriados nacionais que caírem nos dias de terças-feiras e quartas-feiras, e os que caírem nos dias de quintas-feiras serão comemorados por postergação nas sextas-feiras”.
Fábio Trad (PSD) é autor de 28 propostas. Entre elas o PL 928/2019 que proíbe a comercialização de animais em pet shops e o PL 1020/2019 que inclui no Código Penal o crime de stalking, inclusive via redes sociais.
Único deputado petista na bancada, Vander Loubet (PT) apresentou somente um projeto de lei nesta legislatura. Ele é autor do PL 645/2019 que concede benefícios tributários a empresas que contratem trabalhadoras que sejam mães de crianças de até 14 anos de idade.
Já o deputado Dagoberto Nogueira (PDT) apresentou cinco proposições sendo quatro requerimentos e o PL 1162/2019 que altera a Lei n. º 8.078, de 11 de setembro de 1990, determinando que fornecedores informem a média anterior de preços dos produtos em promoção. A intenção é estabelecer uma referência do desconto para o consumidor.

Violência contra a mulher
Feminicídio, aumento das medidas protetivas e leis relacionadas à proteção das mulheres estão sendo propostas na Câmara pelas deputadas federais tucanas. A deputada federal Rose Modesto (PSDB) apresentou até o momento dez proposições – sendo sete projetos e três requerimentos – a maior parte deles relacionados a medidas de combate à violência contra mulher e feminicídio. Entre elas, projeto similar ao que havia sido aprovado quando vereadora determinando o fornecimento de equipamento conectado à unidade policial capaz de emitir alerta ou violação de direitos por mulher vítima de violência.
Proteção às mulheres vítimas de violência também é o tema de dois dos três projetos apresentados pela deputada federal Bia Cavassa (PSDB). Pelo PL 1806/2019, ao invés de dispositivo para a mulher que sofre violência a proposta é o monitoramento eletrônico do agressor, para que a vítima seja avisada via aplicativo ou celular quando ele se aproximar. “Todos os custos do equipamento de monitoração serão custeados pelos agressores”, informou a assessoria de imprensa da deputada.
PSL
Em seu primeiro mandato, Luiz Ovando (PSL) apresentou quatro projetos de lei. Defensor do fim do horário de verão há anos, ele apresentou o PL 1220/2019 tratando do assunto. Mesmo após o presidente Jair Bolsonaro (PSL) informou que neste ano não haverá horário de verão, ele irá seguir adiante com a proposta. “O projeto continua com a tramitação porque queremos firmar decisão definitiva de suspensão do horário de verão e não ficará sujeito às condições políticas, eleitorais e emocionais do executivo, mas sim, fundamentado em fatos econômicos e sobretudo biológico e social”, informou.
Já Loester Trutis (PSL) protocolou o PLP 101/2019 para estabelecer que a taxa municipal ou distrital de coleta domiciliar de lixo e a contribuição de melhoria cobrada em virtude de pavimentação e de melhoramentos congêneres sejam exigidos de forma conjunta com o imposto sobre a propriedade predial e territorial urbana (IPTU).
Ele informou também que irá apresentar 16 proposições no semestre. Entre eles, o que prevê mudança na legislação permitindo e a instalação de fábricas de armas dentro do território nacional com capital estrangeiro. Há intenção, segundo informado pelo deputado, de atrair uma fábrica do segmento para Três Lagoas.
Conforme Trutis, o grupo de deputados de primeiro mandato ao qual pertence traçou estratégia para conseguir emplacar as propostas. “Ao invés da gente simplesmente ter a ideia, protocolar um projeto que a gente não sabe se vai adiantar ou vai andar para a frente devido à força política, a gente prefere costurar primeiro essa ideia, já pegar as emendas antes do projeto ser protocolado e já protocolar esse projeto com no mínimo cem assinaturas. Isso garante que o nosso projeto tenha uma aceitação muito maior e tenha uma tramitação muito mais rápida”, detalhou.
